1: What is a Wrongful Death action?

An action for wrongful death is possible when a loved one wrongfully loses their life due to the negligence of another. It is especially horrifying and painful to those left behind because a loved one was taken unexpectedly and unnecessarily.
2: Who has cause of action in a Wrongful Death case?

In Georgia, laws are in place that determine who has the cause of action against the person or corporation responsible for a wrongful death. Generally, a person’s spouse and children have a right to seek compensation when an adult dies as the result of the negligence or carelessness of another. If the wrongful death of a child occurs, the child’s parents have a right to seek compensation. If the person who has died has no spouse, children or parents the estate of that person has a right to seek compensation.
3: What are damages that may be compensated in a Wrongful Death case?

The damages that may be compensated from a wrongful death lawsuit include pain and suffering, loss of income of the person who has died, reimbursement for funeral and burial expenses, compensation for loss of companionship, and reimbursement for medical costs and other expenses.
4: Is there a Statute of Limitations in Georgia for a Wrongful Death case?

Generally, for an adult victim, the Statute of Limitations runs two years from the date of death. For a minor child victim, the Statute of Limitations depends on the age of the child at the time of death.
